[摘要] :
2022年2月24日，俄羅斯以武力入侵烏克蘭，從而引發所謂的烏俄戰爭。此場戰爭引發大規模的烏克蘭難民紛紛逃往鄰近國家，造成鄰近歐洲國家面臨難民接受與安置的問題。
日本向來以重視人權的先進國家自居，但在其難民法制在過去40幾年來的實施運作，因歷年來極為低落的難民認定率廣受國際社會人權團體的嚴厲批判。此次面對烏克蘭避難民問題，日本政府一改過去保守謹慎的態度，對於烏克蘭的避難民採取更為寬鬆的入境居留措施，並給予其在日本國內生活各方面的補助與扶助。此種政策是否有可能影響甚至改變未來日本難民法制，使其得以朝向更為開放與寬鬆的政策方面，值得觀察。本文將在探討現行日本難民認定的情況與日本政府處理當前烏克蘭避難民的問題之後，針對未來日本在難民法制方面的改革議題方面，提供相關的分析論點。
[英文摘要] :
On 24 February 2022, Russia invaded Ukraine which has escalated as what we called Russo-Ukrainian War. The invasion has caused tens of thousands of deaths on both sides and forced hundreds of thousands of Ukrainian refugees flee away from their home in Ukraine.
Japan, being as an advanced country which respects human rights, has run the refugee rights protection regime for over 40 years but Japan’s consistently low recognition and high incarceration rates of asylum seekers have also been criticized for decades. Facing the Ukrainian refugee crisis, Japan has started to consider the possibility of modifying its refugee protection mechanism. The article is to analyze the current situation of Japanese refugee protection mechanism, especially about the process of refugee status determination, and discuss its progress in the nearly future at the same time.
